Article 2 - General Provisions
2.1. OBJECT
These general conditions of sale (the “CGV”) apply exclusively to the online sale of ready-to-wear products and accessories from the company Classy & Hidden (the “Seller”) on the freely accessible Website.
2.2. APPLICATION DOMAIN
The General Terms and Conditions govern the online sales contracts of the Seller's products to buyers qualified as Consumers, defined as natural persons acting for personal purposes, and constitute with the online order the documents formalizing the distance contract between the parties.
2.3. AVAILABILITY AND COMPULSORY NATURE
The General Terms and Conditions are accessible to Consumers on the Website and must be accepted before any order. Validation of the order constitutes acceptance of the General Terms and Conditions in force on the date of the order.
2.4. VOID - WAIVER
The nullity of a clause of the General Conditions of Sale does not entail the nullity of the other clauses. The fact that the Seller does not avail itself at a given time of any clause of these General Terms and Conditions cannot be interpreted as a waiver to subsequently avail itself of this clause.
Article 3 - Products
3.1. FEATURES
The products offered for sale are described and presented with the greatest possible accuracy. The photographs of the products are not contractual.
3.2. STOCK AVAILABILITY
The products are available while stocks last. In the event of unavailability, the Seller will inform the Consumer and may offer an equivalent product or a voucher or the Seller will have the right to cancel the customer's order and will refund the amount paid within fourteen (14) days.
Article 4 - Price
4.1. SELLING PRICE
The prices of the products are those in effect at the time of the order and are indicated in the selected currency, all taxes included, excluding delivery costs. The total amount due is indicated before order confirmation.
4.2. EDIT
The Seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of validation of the order.
4.3. COSTS
Delivery costs, transport costs and any other possible costs are indicated to the Consumer before validation of the order and invoiced additionally.
Article 5 - Offer
5.1. DURATION OF OFFER
Online sales offers are valid as long as the products appear on the Website and while stocks last.
5.2. ACCEPTANCE
Acceptance of the offer by the Consumer is validated by confirmation of the order, in accordance with the double click process.
Article 6 - Order with Payment Obligation
6.1. STEPS FOR CONCLUSION OF THE CONTRACT
1. Creation of an account by the Consumer.
2. Selection of products and desired quantities in the virtual basket.
3. Verification and validation of the basket.
4. Providing delivery information.
5. Acceptance of the General Terms and Conditions by checking the box provided for this purpose.
6. Payment via the chosen payment method.
7. Order confirmation and possibility of verification before payment.
6.2. ORDER MODIFICATION
Any order modification after confirmation is subject to acceptance by the Seller.
6.3. CONFIRMATION OF THE ORDER
The Seller reserves the right to refuse any order for legitimate reasons, particularly in the event of abnormally high quantities.
6.4. ACKNOWLEDGED RECEIPT OF THE ORDER
The Seller acknowledges receipt of the order electronically.
Article 7 - Contract
7.1. CONCLUSION
The sales contract is formed when the Consumer sends the order confirmation.
7.2. ARCHIVING AND PROOF
Communications, purchase orders and invoices are archived on a reliable and durable medium and can be produced as proof of the contract.
7.3. RESOLUTION
The Consumer may terminate the contract in the event of:
• Non-compliant delivery;
• Exceeding the indicated delivery time;
• Unjustified price increase.
The Seller may terminate the contract in the event of:
• Refusal to take delivery;
• Non-payment of the price.
Article 8 - Payment
Payment is due immediately upon ordering. Secure payment is provided by our payment provider via an SSL connection. In the event of an error or inability to debit the card, the order is canceled.
Article 9 - Delivery
9.1. DELAY
In the event of late delivery, the Consumer may terminate the contract after formal notice remains without effect.
9.2. PLACE OF DELIVERY
The products are delivered to the address indicated by the customer when ordering.
9.3. DELIVERY TERMS
Delivery is made to the address indicated when ordering. The Consumer must check the condition of the product upon receipt and report any anomaly.
9.4. TRANSFER OF RISK
The risks of loss or damage are transferred to the Consumer upon taking physical possession of the product.
Article 10 - Right of withdrawal
10.1. CONDITIONS, DEADLINES AND TERMS OF EXERCISE
The Consumer has 14 days to exercise their right of withdrawal without giving a reason.
10.2. WITHDRAWAL FORM MODEL
The Consumer can use the model withdrawal form available in the appendix.
10.3. EFFECTS
In the event of withdrawal, the Seller reimburses all payments received, except delivery costs, within 14 days of receipt of the withdrawal request. Reimbursement may be deferred until receipt of the goods or until proof of shipment has been provided.
10.4. RETURNING PRODUCTS
The Consumer must return the products to a specific address that customer service will share with them upon request without undue delay and no later than 14 days after having communicated their decision to withdraw. Return costs are the responsibility of the Consumer.
